What rights do we as subscribers have when a list is sold.

Marion Stearns had another comment on this subject and I wanted to add this because this is an important topic that we all have to think of one day as ezine publishers. This is also a tip for those who are considering selling their ezine lists. This quick tip could save you a lot of unnecessary hassle in the long run.

 

""This is a multi-faceted dilemma and cannot be generalized. Many
publishers "state" that your name, email address and personal
information will NOT be sold or given away. In that case, it's
a no-no. However, realistically, when someone sells an ezine, the list IS part of the sales deal.


Pay attention when you subscribe and SEE if the publisher has said that your name will not be sold, traded or given away. If you don't see this, then unsubscribe from the publication, if you object.


The best process that I have noticed is that when a transfer of
ownership OR a merger takes place, a simple announcement by the original publisher should solve the problem. Handled properly, it should cause no real damage. The only question will be which publisher will handle unsubscribes....if the selling publisher does it, he loses value in his sales deal. Naturally, some unsubscribes are expected by both outgoing and incoming publishers. Subscribers always have the option to opt-out when they aren't satisfied.


General "removal" of names from websites is a whole different issue. These 2 situations are not in the same category. Personally, I think this crosses the standard ethics line.


All in all, we must consider the situation. If
a publisher becomes disabled or dies, the ezine may HAVE to be sold. A simple pre-announcement, if possible, offering unsubscribe options can help solve this problem.

Some Things To Know When Selecting a Product to Sell

The time will come when you realize in order to make money online, you need a product unique to you and your business. You cant just base it on the new Flavor of the Month or something that seems to work, use some common sense

Who do you want to buy your product?

Where do you want people to buy your product?

How will people purchase your product?

What is your target audience? Who will this product benefit?

Who is your competition, and what make you different?

Is this product something you would buy on Emotions or with sound judgment?

Sometimes you may see an ad for a certain software that is at a discount for one day only and if you don't purchase the product immediately then you will lose out. ( Note : I am not debating this sales method, but trying to let you know how your customers purchase items) 

The goal is to have your visitors purchase on an ongoing basis. They appreciate your prices, your sales methods, and your product. Regardless of how many other sites there are like yours, they know you offer excellent customer service, a quality product and good support for any questions or concerns you may have. That is the goal, not to be the Flavor of the Month where everyone rushes to buy one month and two months down the line, they don't even remember who you are. 

Sales and specials are wonderful and is mostly used to drum up a bit more business. But if you are only making sales during these "specials" then it is time to re-evaluate your marketing methods. 

Although promotion is an ongoing process, try not to fluctuate between prices often and rely on sales like those to generate income for your business.

Stop trying to be just like your competition and do your own thing. 

There is more than enough to go around, so don't panic if you see someone have a sale and you think Oh I better hurry up and change my prices or I am losing money.

Since the whole Dot Com era has died down a bit, good old fashioned business sales methods still exists and that is what will keep you going..

Article Writing Errors

 

Having trouble writing articles? Here's my list of some 
common mistakes that writers make.

Not being a writer - This is the number one mistake that 
writers make. If you are a writer, then you had better be 
writing. You cannot publish what you don't write. Don't talk 
about what you are going to write, don't discuss your articles 
before writing them, and don't spend endless hours trying to 
find people to purchase your articles. Just write: query 
letters and articles. Write them fast and furious. That's 
what a writer does.

Not writing constantly - If you call yourself a writer, then 
you had better be writing. In fact, you should be writing 
constantly, every single day if you can. What do you write? 
Write an article on something, anything, that you feel you 
can write about. 

Giving into writer's block - You can defeat writer's block. 
You are a writer, so write. Can't write? Just start writing 
and don't worry about what comes out. 

Re-writing too many times - Some writers like to edit and 
rewrite an article over and over again. Personally, I write 
a pretty good article the first time and one quick edit 
usually finishes it up. Some people need a few more edits. 
But don't over edit. Your job is to communicate words 
and concepts on paper, not edit them to death.

Not editing enough - No matter how good your first drafts are, 
be sure and look it over at least once for spelling mistakes 
and grammar errors.

Plagiarizing - It's perfectly okay to get ideas from other 
articles, books, movies, and even television shows. It's not 
okay to steal another writers work, and it's also not 
acceptable to paraphrase an article. You can quote from other 
sources (this is called "fair use") but you cannot make 
other's work your own. Talking about an article before writing 
it - I know of very few people who can talk about an article 
concept with another person and then successfully write that 
article later. Writing is communicating on paper (or on a 
computer), not talking about what you want to write.

Asking people if your writing is "okay" - If you are taking a 
class in writing, then this is a fine thing to do. Otherwise, 
I wouldn't bother trying to get criticism from anyone except 
a professional editor. Before I learned this lesson, I 
stopped writing more articles than I can count simply because 
of others tearing my work apart. Now, I don't ask for or 
accept criticism on my works, unless it's from a professional 
editor to whom I am attempting to sell one of my articles. It 
is acceptable to get criticism from one's agent, as that is 
one of the tasks that an agent is paid to do.

Worrying about what to write about - Don't worry about what 
to write: just write. That's what writers do, they write. 
There is no need to waste time to find a subject or something 
that will sell or anything else. Just pick something you know 
well and write about it.

Not using query letters - If you really want to get your 
articles published, you need to be sending out dozens of query 
letters every single day. How is this done? Simply pick up your 
most recent copy of Writer's Market, pick a magazine or other 
publisher, think of an idea they might be interested in, and 
write a letter pitching that idea to the magazine (or other) 
editor. Be sure to follow the guidelines given by the magazine 
(you can get this from Writer's Market, on the web or by 
sending a request to the publication). You may only get one 
bite out of a hundred, but if you don't ask you won't get any 
at all.

Why use query letters instead of writing articles? Writing an 
article can take a significant amount of time. It's wise to 
find an editor who is at least marginally interested before 
taking the time to write a full article. Query letters must be 
written fast and often to be effective.

Writing in someone else's style - You are a unique individual 
with your own talents, faults, goals, objectives, abilities 
and characteristics. You also have your own unique writing 
style. Be yourself when you write; if you are someone else 
(and you write like someone else) you will never make the big 
times. This does not mean you shouldn't experiment with 
different writing styles; it means you should make each style 
your own as you write.

Asking other writers for advice - This is fine if you are 
taking a class taught by a writer. In most other instances, 
unless the writer is a good friend, you have to understand 
that other writers are competitors. Unless they are very 
ethical, it's very likely they may be trying to discourage you 
or move you away from their own preferred market.

Keeping poor records - Create a record-keeping system and 
stick to it. There is little more embarrassing (or time-
wasting) than sending out the same article twice (or more) to 
the same editor who rejected it the first time.

Not treating writing as a business - Keep good records of 
expenses and income, and treat it all as important and vital. 
You have to pay taxes and you may need to account for any 
money. Also, expenses (and even your home office) are often 
write-offs on taxes.

Not checking facts and doing proper research - Getting a fact 
wrong now and again won't kill you, but it does effect your 
credibility. Get major facts wrong too often, and you may find 
that you cannot sell anything anymore.

Not handling copyright infringement - If someone steals your 
work without compensation, handle it fast and efficiently. 
Talk nicely, then not so nicely, then call in the lawyers. 
You own the copyright, so enforce it.

De-Spam Your Inbox: How to Fight the Spam War and Win!

Spam, Spam everywhere... what's a person to do? If you're
an online entrepreneur, odds are your mailbox is filling
up daily with Spam. The longer you've been "working" the
Net and the more visible you've become, the more you're
probably receiving. I've been online about five years now,
and one of my mailboxes alone is over 85% Spam.

First, you need to realize that Spam is part of doing
business online and there's really no escaping it. But
that doesn't mean you can't rid yourself of it by using 
the right tools and arming yourself for daily battle.

There are many excellent tools, some even free that will
help you fight the war on Spam and Win! Let's review some
of my personal favorites:

1) Spam Net: http://www.CloudMark.com 

This excellent piece of software is a relative newcomer
and free to download. It only works with Outlook and 
runs invisibly in the background of your mail program.
The software adds 2 new buttons at the top of Outlook's
interface named "block" and "unblock" and adds a "Spam
folder" where it puts all of the Spam it finds so you 
can review it if you want before deletion.

If you get a piece of junk when you download your mail,
just hit the block button. This sends it and whatever
the sender tries to mail you in the future straight to
the Spam folder. It also casts your vote to Cloud Mark
and when they receive enough complaints on a sender
that mail is automatically labeled as Spam. 

If, after reviewing the Spam folder, you find something
that doesn't belong there, just highlight it and click
the "unblock" button to bring the sender back in to your
inbox forever more. Right now this software only works 
with Outlook, but there is talk about a version for 
Outlook Express coming soon. I've been using this 
software for a few months and am very pleased with 
the results. Runs on Win 98/NT/2000/XP.

2) Mail Washer: http://www.MailWasher.net 

Another ad-supported free piece of software that works
beautifully. I've been using this with my Outlook
Express accounts and couldn't be happier. You run
Mail washer before downloading your mail from your
server. It automatically marks mail it suspects
as Spam - then you can designate the sender as a "friend"
or blacklist him with just a click. You then click 
"process mail" and any "bad" email is bounced back to 
the sender and the good stuff is sent to your inbox. 

You can upgrade Mail washer to an ad-free version by
sending a donation to its creators. Believe me, you'll
love it so much you'll want to send them money for all 
the headaches this software will save you. It can be 
configured to check multiple accounts so it's great 
if you're managing multiple identities and boxes. It
does not support web based accounts like Hotmail or 
Yahoo, but a version is supposedly underway for them.
Runs on Win 95/98/ME/NT4/ 2000/XP

3) Spam Buster: 
http://www.Contactplus.com/products/spam/spam.htm 

The free version of this software is ad-supported, 
which means it displays banners at the top. If you
spend the 19.95 and register it, the ads are removed.
Before using your POP mail account you run Spam Buster,
which looks for junk and comes complete with a list 
of over 17,000 known spammers. It checks your email
periodically for new messages and provides stats and
charts of how much Spam you're actually receiving.
Also Works with AOL, Hotmail, or Yahoo! accounts.
Works on Win 95/98/2000/ME/NT/XP

4) Mail Shell: http://www.MailShell.com 

Blocks 99% of all junk mail and works with your
current email address. Free 30 day trial available.
Less then 3.00 a month after that

5) Spam Killer:
http://www.mcafee.com/myapps/msk/default.asp 

Spam Killer was recently purchased by Mcafee Software.
who makes the award winning virus software. Works with
POP based email accounts and will run you 39.95. Like
most Spam filtering software, it checks for new email
and possible Spam on your server before downloading it
to your email client. Filters are automatically updated
and you can create your own custom filters. You can
also lodge complaints with spammers and their hosts
from within the interface. Supports Win 95/98/NT/
ME/2000 or XP.

6) JunkMuncher.com: http://www.JunkMuncher.com 

Works with POP email accounts and includes its own
email porn filtering utility. Does not support AOL or
Hotmail accounts. 

7) Spam Weasel: 
http://www.mailgate.com/products/spamweas/sw_feat.asp 

Free software that supports multiple email accounts.
Spam Weasel uses powerful rules to identify Spam and
permits a range of user defined actions like blocking
and deleting. Easy to Install and use.

8) Spamex: http://www.Spamex.com 

Spamex offers disposable email addresses so you keep 
your real address off spammers' lists. Mail sent to 
the fake address is then forwarded to your real email
account. As soon as the disposable account starts 
picking up Spam and being abused you can delete it 
and create a new one. 19.95 a year.

9) Choice Mail: http://www.digiportal.com/product4.html 

A Spam blocking system that's based on the fact that
most incoming mail is Spam unless the sender has 
obtained your permission to email you. You may 
preapprove senders from your address book. When an
unauthorized email is sent to you, its sender is forced 
to fill out a form stating why he should be allowed to 
communicate with you. Then it's your choice whether or
not to receive messages from him.

Supports POP accounts and runs on Windows NT, 2000, XP, 
98, ME. It does not currently work with web-based 
email systems such as HotMail, Juno or Yahoo or with 
MSN or AOL's proprietary email. Currently offering a 
2-week trial of their service, or buy it for 39.95.

10) Spam Arrest: http://spamarrest.com/ 

Another service that blocks the junk before it can hit 
your inbox. All email goes through their server first,
and if the sender is already a "verified source" their 
mail travels to you seamlessly. If they are not, you'll
need to add them to your approval list to make sure 
you continue to receive their emails without any 
interruption.

Spam Arrest works on Eudora, Outlook, Outlook Express,
Netscape, Incredimail, and any other email program 
that supports the POP3 protocol. Free 30 day trial is
available and if you like it the price is only 19.95
every 6 months.
